Adam Scott, 20, was killed at a Gallitin County surface mine when the loaded Midwest Auger Company truck he was driving on an incline rolled backward and turned over on him, due to what appears to have been a stalled engine or weak traction, according to the Associated Press.

Larry Brunner, then a foreman for the operation, also received two years of supervised release and a $500 fine for telling federal investigators that no complaints had been received about the working condition of the vehicle, the news service said.

The sentence comes just weeks after Illinois state senator Richard Durbin announced plans to bring forward new legislation to help keep all of the state’s miners safer.

“Safety violations often result in injuries that cost miners their health, livelihood or lives,” he said in late March when proposing the Mine Safety, Enforcement, Reporting and Training Act of 2006.

“We have more than 3500 miners in Illinois. We owe it to them and to their families to ensure all ... Illinois [operations] are being held to the highest standards of safety,” Durbin said.
