The company reopened the mine on the proviso it would continue to pursue a compromise with the state that would allow full extraction mining under the creek, The Pittsburgh Post-Gazette reported on Wednesday.
Work begun back at the mine at midnight on Wednesday.
Although the company has only confirmed that miners have returned to for maintenance, United Mine Workers of America district 2 president Ed Yankovich Jr. issued a statement stating full operations had resumed.
Yankovich said Maple Creek was pursuing an agreement with the DEP that would allow it to longwall mine under the stream after it takes measures to prevent water loss from subsidence.
The DEP originally found Maple Creek could not comprehensively prove it could protect the stream from subsidence effects.
