Alliance subsidiary Excel Mining received the 107(a) order on July 10 at its Mine No 3 in Kentucky when a representative of MSHA allegedly observed two miners travelling in the mine in an unsafe manner.
In a US Securities and Exchange Commission filing Alliance said no accidents or injuries resulted from the danger order, which was terminated 30 minutes after it was issued.
Imminent danger orders are issued by MSHA under section 107(a) of the Federal Mine Safety and Health Act, also known as the Mine Act.
Mine No 3 is in the underground MC Mining complex in Pike County, Kentucky.
It is owned by Alliance and operated by Excel.
According to Alliance’s website, the mine produced 1.5 million tons of low-sulfur coal in 2011.
