Virginia officials deny surface permit

In a document provided to ILN, the DMME said certain violation issues had to be resolved, with fees and bonds due to the state’s Division of Mined Land Reclamation by November 2012 not being received.

Ison Rock Ridge, planned near Appalachia in Wise County, also was ultimately denied due to a state regulation stating that new permits or acreage amendments be submitted “in excess of 24 months from the initial receipt of the application by DMLR”

The lapse in time for the 1230-acre proposed operation was due in large part to the operator, according to the document.

The permit application was first submitted in March 2007 and was technical-approved in May 2010. The November deadline to clear up the other issues was postponed to February 13 of this year but those issues were still unresolved at that time.

A&G appealed the decision at an informal hearing last week.

A hearing officer has 30 days to decide and that decision is expected to be released within 90 days.

A&G did not publicly comment on the permit denial or appeal.
