On Thursday, the Land and Environment Court slapped Moolarben Coal with the fine, marking the second fine the company has received in less than a month.
On April 3 Moolarben was fined $105,000 for a 2009 incident that led to polluted water flowing into the Bora Creek.
In the latest incident, the court heard that the company polluted Bora Creek with water consisting of earth and sediment from its mine site.
Moolarben said it accepted the NSW Land and Environment Court ruling and deeply regretted the incident.
However, Moolaben said the incident occurred when the company was under prior ownership.
“The discharge event of December 2009 occurred when Moolarben Coal was owned and operated by previous owner Felix Resources,” the company said.
“Under the current management and ownership of Moolarben Coal there has been no environmental prosecution during the past two and a half years.”
Under the ownership of Yancoal, Moolarben said it had since completed the implementation of erosion and sediment control works, capable of controlling any significant rain event similar to that of December 2009.
Moolarben now employs a team of six environmental scientists who monitor conditions in and around the mine on a daily basis.
