According to state legal journal the West Virginia Record, Luke Shumate filed documentation for the suit August 9 in the Circuit Court of Raleigh County.
He named Arch as well as Mike Williams, and cited a hostile work environment as well as wrongful termination, retaliatory discharge, intentional infliction of emotional distress, violation of statute and assault.
Specifically, Shumate said that during his three-year tenure he was threatened by Williams during shifts. Despite being told by Arch management he would no longer work with the defendant they were scheduled weeks later for the same shift.
The plaintiff refused to work with Williams and was subsequently terminated, he said in his complaint.
Shumate is seeking an undisclosed amount in damages, including punitive damages.
He is being represented by Thomas Rist of Rist Law Offices.
The case is formally filed as 13-C-648 in the Raleigh County court.
